MANILA, NOVEMBER 25, 2011 (TRIBUNE) Noynoy seems
confident that he is on a roll after putting one over the Supreme Court (SC) on
the matter of the temporary restraining order (TRO) that, despite being upheld
by an en banc meeting of the court, was superseded by an unusual display of
speedy justice on the poll fraud complaint against former President Arroyo
resulting in the arrest of Gloria on the same day of the SC decision.
In his running open conflict with the Chief Justice, the Friday maneuver on
Gloria was convincingly a full point for Noynoy.
That event was what likely inspired Noynoy to trumpet to one and all, during
a speech delivered in Tagalog the other day before the National Bureau of
Investigation (NBI), that his will, will prevail over whatever the SC decides
on, which was the gist of what he said about his readiness to defy any ruling of
the tribunal that he believes to be "favoring the interests of the few."
In so many words, Noynoy said that he is determined to triple the efforts in
making Gloria and her cohorts accountable for their past excesses that the
country was just a witness to last Friday.
What had transpired on that day and the few days preceding that, however,
disturbed many since it was a show of how the executive can give the SC the
runaround on implementing the decisions of the high court.
Justice Secretary Leila de Lima who mapped out the options of the executive
on that day was even brash in claiming that there was no intent to defy the SC
in withholding the implementation of the TRO on the travel ban issued on Arroyo
and her spouse Mike.
The fact was that the TRO was issued and it was explicitly indicated in the
document that it was executory but the executive did not implement it anyway.
The Palace had refused to call the legal tug-of-war last Friday as part of
the rift between Noynoy and the SC, but to many observers there was no intention
from Malacañang or the Justice department to comply with the TRO.
The game it seems, is far from over for the perceived Noynoy-SC clash as many
from the backyard of Noynoy are tying up the decision of the SC for actual land
distribution on Hacienda Luisita owned by the Cojuangco-Aquino clan of Noynoy to
the rift, or as a way of the tribunal to get back at the executive.
Despite the denials from both the Palace and the SC, the recent political
events definitely have the markings of a cold war between Noynoy and the
executive on one side and Chief Justice Renato Corona and the SC justices
appointed by Gloria on the other.
The rift all started when Noynoy, even before and continuing after, his
assumption of the presidency, called on Corona to resign to pave the way for his
own appointee as head of the highest court of the land despite the fact that the
Constitution guarantees his term.
Corona was appointed during the twilight of the term of Gloria which was not
at all his fault since it just happened that former Chief Justice Reynato Puno's
resignation fell on that period.
Noynoy, in his recent NBI speech, threw a lot of hints about further defying
the SC on decisions that he will deem to be not resolved in his favor.
The recent actions of the executive all point to isolating the Gloria
appointees in the SC likely to make them ineffective, in turn making SC
decisions irrelevant to his administration.
The probable result is Noynoy ignoring the high court for most of his
controversial moves whose legality which will be challenged at the tribunal.
One-man rule is clearly discernible through Noynoy's statements.

Everybody in officialdom allied with Noynoy wants the doctors of Gloria
Arroyo summoned to testify on the health condition of the former Chief
Executive.
The Solicitor General wants the high court to summon these doctors to testify
during the oral arguments, claiming that it was Gloria who in her plea to the
high court for a temporary restraining order (TRO) to stop the Department of
Justice (DoJ) and its watch list order from preventing her travel for medical
treatment abroad, as being invoked by her was her right to life.
The Solgen wants the doctors to testify if Gloria's ailment is
life-threatening, while the Senate panel also wants the Arroyo doctors to
testify before the Senate on her health status, despite the fact that this is
hardly the business of the Senate, since such can hardly be in aid of
legislation, nor does it have anything to do with the poll fraud probe into
which the panel is looking into.
Blue ribbon chairman TG Guingona claims it is puzzling to him that it is not
the doctors who give out medical bulletins but the Arroyo spokesmen and he
wondered why in the past, there were always medical bulletins issued by doctors
everytime Gloria was hospitalized, yet today, the doctors are no longer issuing
bulletins.
That's pretty malicious of Guingona, considering the fact that then, Gloria
was the Malacañang tenant, and as such, medical bulletins have to be issued, as
a president's health condition must always be made public.
Gloria is merely a congressman, and as such, there is no need for her doctors
to issue medical bulletins, especially if the patient, in this case, Gloria, has
not provided her doctors to issue such bulletins.
Noynoy of course, has the same line of the Solgen. He does not believe that
her condition is life-threatening and that she is using her ailment to evade and
escape the charges.
Not to be outdone, the Pasay City Regional Trial Court judge hearing Gloria's
electoral sabotage case, also summoned the doctors of Gloria to testify before
the court — to check if she really needs to have hospital arrest.
The doctors have already said that if summoned, they will testify.
But just what is it that they will be asked to testify on?
Whether or not Gloria's ailment is life-threatening?
But what is meant by life-threatening? Is it not when there are already early
signs of organ failure — in which case, it may be too late to save a patient, if
organ failure has set in without the proper medical treatment.
There are other considerations that have to be factored in, such as the
eventuality of a patient who may have the rare bone disease that could leave her
paralyzed, in which case, she survives, but will be denied the quality of life,
owing to the fact that she had been prevented from seeking further medical
analysis and treatment abroad, which is being denied her by the government.
A group of pathologists belonging to the Philippine Medical Association has
come out to admit that while a bone biopsy can be done here, it will be the
first time doctors here will be doing it, and admitted further that the biopsy
will have to be sent abroad for analysis.
If you are the patient and the tests have never been done in this country
before, are you going to risk it with a first time experimenter? Wouldn't you
rather go to a doctor who has done this many times over and specializes in such?
Doctors Enrique Ona and Leo Olarte who apparently has links with Malacañang,
should at least have the grace to be shame-faced, claiming that we have local
doctors who can take care of the ailment of Gloria, since the pathologists from
PMA has admitted this has never been done here by our doctors.
So what is it that Noynoy, his Solgen, the Senate panel really want to do?
Let her leave when she is already close to breathing her last, or when she is
paralyzed?
Hatred certainly has taken over reason in this country under Noynoy and what
we have today is no longer a democracy but a yellow mobocracy.
