BELO JUBILANT OVER DISMISSAL OF HALILI'S CASE VS KHO
MANILA, DECEMBER 18, 2010 (BULLETIN) By NEIL RAMOS — Cosmetic surgeon Vicki Belo is overjoyed with the courts' recent decision to dismiss the criminal charges filed by actress Katrina Halili against boyfriend, Hayden Kho Jr.
Belo deemed the verdict a "big blessing" and the "best Christmas gift."
"Kasi napakabigat noon [charge]. Kahit anong ginagawa namin, at the back of our minds, may worry. Pero ngayon [we feel] peaceful [na]," she said in an interview with a local news network.
Belo went on to relate that she and Kho offered mass to show gratitude over the blessing.
"He was very grateful. The nice thing about it, I think the whole thing happened para bumalik siya [Kho] sa Diyos."
Belo insists she doesn't feel even a tinge of resentment when Kho intimated to the media that he wanted to talk to Halili to finally patch things up between them.
"Gusto lang naman niya closure, I suppose. Hindi ko lang alam kung kailan mangyayari yan pero sana soon para maka-move on na 'yong dalawa," she said.
The beauty doctor refuted notions that she still harbors ill-feelings towards Halili. She went on to profess that Kho feels the same.
She maintained, "Alam mo si Hayden kahit ano mangyari wala siyang sama ng loob kahit kanino. 'Yon ang ina-admire ko sa kanya na sobra siyang forgiving. Wala akong naririnig. Never siyang nagsasabi ng bad things about anyone. "
Halili charged Kho with violation of Republic Act (RA) 9262, or the Anti-Violence Against Women and Children Act, after a sex video featuring her and Kho—which she claimed was taken without her knowledge—went viral.
In his ruling, Judge Rodolfo Bonifacio dismissed the 100-million suit citing "insufficiency of evidence."
The resolution affirmed that "evidence is insufficient to prove that the sex video was taken without the private complainant's knowledge."
It added that the recording of a sex act on video without one of the involved party's knowledge and consent is not a violation of Republic Act 9262.
"It becomes a crime only when the said act alarms or causes substantial emotional or psychological distress to the woman," it stated.
The resolution also noted that the prosecution failed to provide any evidence that it was Kho himself who uploaded the videos illegally.
Halili's lawyers intend to appeal the court's decision.
Belo is far from worried about the matter, however, saying that it is already "expected."
"They [Halili's camp] have the right to appeal," she quipped.
In the meantime, Belo said she is content to simply bask in the euphoria of the moment.
"It just feels good to be vindicated for him [Kho]. Ang sarap ng feeling na ganito."
She hopes that the Professional Regulation Commission (PRC) will reinstate Kho, whose medical license as a cosmetic surgeon was canceled after Halili lodged a complaint before them. In its decision, the PRC deemed Kho guilty of "immorality, dishonorable, and unethical conduct
