Ager - Nineteen senators have voted to convict Chief Justice Renato Corona for
his failure to disclose to the public his statement of assets, liabilities, and
net worth (SALN)..
Senator Manny Villar was the 19th senator who gave a "guilty" verdict for
Corona.
It was Senator Ramon "Bong" Revilla Jr, a known ally of former President and
now Pampanga Representative Gloria Macapagal-Arroyo, who cast the 16th vote, the
magic number needed to convict the Chief Justice.
The 19 senators who voted to convict Corona were the following:

OPINION: THE MYSTERY OF FRIDAY
HEARING

is a weekly review of the impeachment trial of Chief Justice Renato Corona. It
aims to help the public appreciate the legal issues and enable them to be
engaged more meaningfully in this historic process.)
The mystery of the Friday hearing was why both parties were no longer
interested to look at the bank accounts. But what is really perplexing is why
the Senate itself could very well have opened the accounts—but balked. Either
the senator-judges had already made up their minds, and there was no point
prolonging the agony. Or the senator-judges knew that, in the final reckoning,
it is not questions of fact that will decide this case but questions of law,
morals or public policy.
The prosecution says that its evidence is already complete. After all, Chief
Justice Renato Corona himself has already confessed to the facts: he admitted
that he held $2.4 million in four dollar accounts and P80 million in peso
accounts. He admitted that he did not disclose the dollar accounts in his
statement of assets, liabilities and net worth (SALN). For the prosecution, that
makes an open-and-shut case. The law is clear, the facts indubitable. No
guesswork needed. All we need is the straightforward application of the letter
of the law.
The defense says that the prosecution hasn't proved anything. The wealth can
be explained. The dollar accounts are from Corona's savings from way back, while
the peso accounts are commingled savings of several members of his family. He
didn't declare the dollar accounts in his SALN because the law provides that
foreign currency deposits are "absolutely confidential." He didn't declare the
funds earmarked for the Basa-Guidote heirs because they weren't his.
Defense has big problems
There are big problems with the defense's case. First, all the explanations
that the assets had been legitimately acquired are irrelevant. The prosecution
actually failed to charge the Chief Justice for ill-gotten wealth (for which
they have been faulted) and indeed the Senate barred all evidence on that point.
The only issue before the Senate is the nondisclosure in the SALN.
Second, the defense is plain wrong when it argues that the SALN requirement
itself allows exceptions "in accordance with law," in this case, the Foreign
Currency Deposits Act. There is simply no such exception. The SALN reporting
obligation covers all assets, peso and dollar alike. The proffered distinction
is totally contrived.
Worse, to exempt dollar deposits from the SALN will defeat the law's purpose
altogether, and tear a giant hole in the net meant to catch grafters.
The only way the defense can pull it off is for them to plead that the
omissions do not rise to the level of an impeachable offense. Perhaps that is
why they took pains to show how the wealth was legitimately gotten.
The defense can argue that nondisclosure is not mala in se (wrong in itself)
but merely malum prohibitum (wrong because prohibited). (For show biz buffs,
this was Ellie's first recitation answer in the movie, "Legally Blonde.") The
evil sought to be avoided is graft, while the SALN is merely one mode of
enforcement. The root evil was never the subject of the proceedings, and mere
mala prohibita cannot amount to an impeachable offense.
On the other hand, the prosecution can argue that precisely, if it's malum
prohibitum, it doesn't require intent. The omission is criminal in itself
without having to show intent to conceal.
Evidentiary problem
On the other hand, if the prosecution insists on applying the law
mechanically, they face equally mechanical evidentiary issues. The undeclared
wealth is right now proved with the testimonies of two people: the Ombudsman
($12 million in 82 accounts) and the Chief Justice himself ($2.4 million in four
accounts and P80 million in peso accounts). The prosecution itself has said that
Corona's statement is legally worthless and didn't even bother to cross-examine.
They are then left with the Ombudsman's accounting but it's too bad they chose
not to open the actual bank statements.
Senate reluctance
The Senate itself wasn't interested in hearing more facts.
First, it refused Sen. Miriam Defensor-Santiago's plea to subpoena the bank
managers. Next, even after Chief Justice made his waiver absolute, the Senate
President declared the Senate "not a producer of evidence, but only a hearer of
facts" and would "merely take note of the waiver [but not] act on it."
That is correct but it wasn't always his position. Recall that the Senate
subpoenaed witnesses on its own before, when they were incensed at confidential
bank documents being leaked to the Senate, and they summoned several witnesses
sua sponte (on their own accord). Even defense counsel Serafin Cuevas wondered,
"Whose witness is this?" The rules assume that a witness has to be offered by a
party (exactly what Enrile now says), but earlier everyone was saying that the
impeachment was sui generis anyway.
Monday's oral arguments
The purpose of Monday's oral argument is to help the judges make up their
minds by weaving together the facts with the legal arguments. The past 42
hearing days were evidentiary; it played the detective's whodunit game. Monday's
hearing is a different ball game. In it, the parties marshal their facts and
frame their theory of the case.
And then the senators vote. Each article of impeachment will be voted on
separately. Each senator will be called individually to state his vote and may
explain briefly.
The oral argument is superfluous if the judges have already decided, or will
not decide on the basis of the merits of the case anyway. But it can be decisive
if the senator-judges realize that sound reasoning is necessary to make their
verdict just.

(PHILSTAR) SEARCH FOR THE TRUTH By Ernesto M. Maceda - The
moment of truth has come. The Senate heard closing arguments from prosecution
and defense panels yesterday after which the Senators will cast their vote of
conviction or acquittal of Chief Justice Renato Corona.
Both sides expressed confidence that they will win the vote with Malacañang
giving an 18-5 estimate for conviction and defense lawyers saying they have the
8 votes required for acquittal.
The main issue has come down to whether the Foreign Currency Deposit Act
quarantees the confidentiality of dollar deposits and therefore need not be
reported in a statement of assets, liabilities and networth (SALN).
With regards to the peso deposits, CJ Corona explained he did not declare the
peso deposits that did not belong to him. He said they belonged to his wife
Cristina, his children and Basa-Guidote Enterprises, Inc.
The other legal issue is whether non-disclosure of assets or bank deposits in
a SALN is an impeachable offense which the law allows to be corrected. The
defense argued that non-disclosure of assets in a SALN is not serious or neither
is it a high crime like treason, bribery, graft and corruption or other high
crimes and therefore does not constitute an impeachable offense.
The individual senator judges will decide these 3 legal issues according to
their interpretation of the law.
The issue is so debatable, an informal survey shows 3 Law school deans say
that the CJ will be convicted while 2 say there is insufficient evidence for
conviction.
Columnists are also divided, broadcasters appear to favor a guilty verdict.
Malacañang has funded a propaganda blitz.
The Senators will cast their vote today. They will vote in alphabetical order
with Senator Angara voting first and the Senate President voting last.
Day 43 the prosecution assigned their oral argument hour to Congressman Niel
Tupas III and Cong. Rodolfo Fariñas. The closing argument was done by Speaker
Feliciano Belmonte Jr. The defense case was presented by lead counsel Serafin
Cuevas and Atty. Eduardo delos Angeles.
The Senate gallery was jampacked Monday and Tuesday with the Corona and Basa
families in attendance. Also seen were Majority Leader Neptali Gonzales II, Gov.
Chavit Singson, Congw. Annie Susano, Midas Marquez, Congresswomen Trisha Bonoan
David, Ivy Arago, Nancy Catamco and Emmie Calixto.

ANOTHER FISH KILL . . After successive fish kills in Laguna de Bay, Taal
Lake, Pangasinan and Camarines Sur, another deadly fish kill hit Laguna Lake a
few days ago.
It is clear that the Department of Agriculture has not been able to find the
solution to the fish kill problem.
It is supposed to be a simple problem due to lack of oxygen caused by over
stocking. Why can't DA/BFAR conduct an information and education campaign to
prevent fish kill?
Another clear case of government inefficiency.

GOOD CHOICE . . The appointment of Career Diplomat Sonia Brady as Ambassador
to China is an excellent one. Ambassador Brady has previously served as
Ambassador to China from April 2006 to January 2010 and therefore has experience
dealing with the Chinese government.
Before that, she served as Consul at the Philippine Embassy in Beijing from
1976-1978.
Brady graduated with a Bachelor in Foreign Service from the University of the
Philippines and her Master of Arts in International Relations from the
University of Southern California.

WHY ONLY NOW? . . After so many years of indecision, Agriculture Secretary
Proceso Alcala announced plans to put up 40 mini hydropower plants at a cost of
P 20 million each. A mini hydro plant could produce at least 20 megawatts of
electricity daily and can benefit 100,000 people.
Why only 20? Why not a hundred at a cost of only P1 billion?
NIA has identified 79 irrigation systems that can be tapped to produce
electricity.
As earlier suggested, how about building water impounding dams to conserve
rainwater?

STALLED . . With only one week to go before adjournment on June 7, the Sin
tax bill has been stalled in the House of Representatives. A strong lobby by
cigarette manufacturers and joined by Northern Luzon Congressmen has watered
down the bill from a proposed additional tax collection of P60 billion to only
P33 billion.
Former Health Sec. Alberto Romualdez wrote a paper pointing out that the
amended version reduced the DOH budget for Universal Health Care.
It looks like the cigarette manufacturers are again winning the battle
against smoking. The bill is still to be taken up by the Senate.

TIDBITS . . . Scout Ranger PFC Maximo Pasking was accused of killing two
persons in San Jose del Monte, Bulacan last May 22.
The Puerto Princesa Underground River is now drawing 1,400 tourists a day.

Batangas teachers numbering over 1,000 are holding a Summit on Thursday, May
31 at the Batangas City Convention Center.
Dr. Dexter Buted is the chairman of the Alliance of Batangas Educators and
School Administrators.
Vice President Jejomar Binay is in Kuala Lumpur, Malaysia to address the
Philippine Malaysian Investment Forum.
The Chinese ban on Philippine banana exports is still in force. They have
shipped back 240 containers to the Philippines.

THE sudden and unexplained exit of Chief Justice Renato Corona from the
witness stand on his first appearance one week ago today has been interpreted by
the public, attendees, and television viewers as arrogance, rudeness, and
disrespect of the impeachment court for which the Chief Justice, in a lightning
twist of fortune, blew his chances, and may have altered the odds from earned
sympathies to disappointment and let down.
In empathy to the Chief Justice, diabetics easily understand and appreciate
the predicament of the Chief Justice when diabetic attacks ensue, accompanied by
elevated blood pressure which Chief Justice Corona also suffers from, after
having undergone previous by-pass operations.
Not having eaten a full meal, famished, and stressed out, the Chief Justice
experienced a hypoglycemic attack that rapidly plunges the sugar level to the
bottom, that is not only life threatening but spirals the patient to a comatose
situation, and even death, unless reversed on time.
Unlike cases of hyperglycemia, which is the steady elevation of the sugar
level; the hyper condition can be arrested by timely injection of insulin.
Thus, after nearly three hours of continuous narration without lunch, the
Chief Justice may have agonized not only from the urge to urinate, which is
common among diabetics, but also from nausea and dizziness from hypoglycemia and
high blood pressure.
Needless to say, this layman explanation does not excuse the Chief Justice
from being criticized for his apparent rudeness and disrespect for the
impeachment court for which the Chief Justice has only himself to blame.
In the meantime, it is best that the Senate put a closure on the impeachment
trial, and move on as the nation pines for economic gains, unity, harmony, and
peace that two years of the Aquino administration have not accomplished, and
neither the Senate nor the House of Representatives had done any better. So far,
it has been an unproductive 15th Congress.
Truth to tell, with his weakened health and exhaustion, hectic
cross-examination, and direct interrogation by foaming-at-the-mouth adversaries
and partisan senator-judges, it is doubted that the Chief Justice can physically
weather the pressure and survive the ordeal, the verbal assaults, and stresses
of the trial, and still hopefully acquit himself.
For the Senate, it is decision time. Cut, and cut clean.
It goes without saying, whether the verdict is acquittal or conviction, that
President Benigno Simeon Aquino III should now focus on the economy and move the
nation forward, and leave the tragedy of the impeachment to history to judge.

When all is said and done, who is Chief Justice Renato Corona? Does he
deserve all the pain, cruelty, vendetta, insults, humiliation, falsehoods, and
vindictiveness in a Christian and democratic nation? The sadism of the elites is
showing.
Are we done? Not by a long shot. President Benigno Aquino III will now gear
up and start revving up the engine for the filing of plunder cases and continued
incarceration of former President Gloria Macapagal Arroyo who is next in the
Order-of-Battle of President Aquino.
The charade and farce continue.
Hence, are we forever condemned to be a weak republic?

Timothy Bradley is training so hard he may have nothing left in him by the time
he steps inside the ring with Manny Pacquiao.
The undefeated American is killing himself in training.
During yesterday's conference call, the hungry challenger to Pacquiao's WBO
welterweight crown said he's looking at a total of 160 sparring rounds.
If that's how he does things for a fight, that's fine. But if he thinks that
putting on the numbers in training would double his chances of winning, he could
be wrong.
Bradley said the chance to fight Pacquiao is an opportunity of a lifetime,
and he wants to make the most out of that opportunity.
He said he'd beat Pacquiao on June 9 in Las Vegas. Or die trying.
"The time is already here, the moment. I am ready to take the throne. I'm
excited," he told the media during a conference call from his training
headquarters in Indio, California.
On Tuesday (Wednesday in Manila) he holds another media workout at the
Fortune Gym along Sunset Blvd. in Los Angeles, and the following day Pacquiao
holds his own media workout at the Wild Card Gym along Vine street.
Bradley is leaving no stone unturned in his preparations.
"Training and preparation have been going great. I am in the best shape of my
life. When we are done I will have sparred about 160 rounds. I have been
training for almost three months now," he said.
"I am on weight. I left the gym at 147 pounds today so I will probably be
coming in kind of light the day of the weigh-in maybe 145 or 144. I am just
eating a little bit more and I feel great. I am confident and I am ready to
deliver," Bradley added.
Pacquiao is wrapping up his training, and has started to taper down in
sparring. By the time he leaves for Las Vegas on Monday of fight week, he'll be
looking at a little over a hundred rounds in sparring.
With less than two weeks left to the fight, Pacquiao must be around the same
weight as Bradley's, and may tip the scales at around 145 lb. As a welterweight,
the 33-year-old champion climbs the ring just under 150 lb.

"American Idol" runner-up Jessica Sanchez was among the stars who came out to
celebrate the Memorial Day weekend in the United States.
The Filipino-Mexican singer was part of the star-studded lineup of performers
for the National Memorial Day Concert in Washington D.C.
Sanchez led the singing of the American national anthem "The Star-Spangled
Banner."
She shared the stage with the National Symphony Orchestra and fellow
performers including "Idol" alumnus Chris Daughtry, Grammy winner Natalie Cole
and country superstar Trace Adkins.
Sanchez was also supposed to sing "The Prayer" and "God Bless America" live
but the show was cancelled half-way through due to bad weather.
According to the official Twitter account of PBS, the management just decided
to air yesterday's dress rehearsal to fill in the second half of the show.
"The first 45 minutes of tonight's Natl Memorial Day Concert were broadcast
before weather forced rest of the show to be canceled," it said.
"#MemDayPBS concert cancelled half way through due to weather. We edited in
video from yesterday's dress rehersal to fill in 2nd half," PBS added.

"Makati can't be an old city. It can't be a has been," said Jejomar C. Binay,
then Makati City mayor now Vice President of the Philippines to his son Jejomar
Erwin Binay Jr., the incumbent city mayor.
"We're doing our best to keep Makati the premier city of the Philippines,"
said mayor Binay, who, with less than two years in the office, is facing the
challenge of filling in his father's shoes. "We've proven this last year," he
continued, "we had a surplus of 2.8 billion and we have increased our local
revenue to four billion pesos."
From a swampland said to be dismissed as worthless by Juan Miguel de Legazpi
in 1571, Makati has evolved into the financial and commercial capital of the
county. It is the where the Central Business District is located along with
thriving service industries, and is number one in the Philippines when it comes
to Business Process Outsourcing.
Explaining how Makati achieved this status, Binay said it was a matter of
working well with the stakeholders, especially those in the business community.
"We are proud to say that we have increased collection even without increasing
taxes. We don't want to be an additional burden to the business community as
well as the residents," he further noted.
Despite Makati's image as a high-class city, it has attracted people from all
walks of life from those in the high-income bracket (particularly in the central
business district) to those in the mid-income and low-income brackets. "It's a
good mix, because what we've learned is that you can't be a purely upscale city;
otherwise where will the workers come from?" he said.

When asked why people flock to Makati, Binay readily replied: "Because it's
the best place to live in." For one, the civil servants are trained to be good.
The quality free education available along with other student benefits is
another reason why a lot transfer to the city. The senior citizens also get to
enjoy numerous benefits. "People here are very spoiled," added Binay with
laughter.
Running the city like a businessman
Binay credits much of Makati's progress in the past years to what his father
did invest in the right things. But the bottom line, for him, is good
governance: "He was sure of his priorities. He made sure that he would lessen
corruption in government. The annual budget back then was around 250 million and
there was still a deficit. When he left, Makati's money was close to 10 billion.
As an Ilocano who is very thrifty, my father was able to save a lot of money for
the city."
Like his father, Binay wants to make sure that the city's money is used on
projects that will give them more money in the future to spend. "It's like
you're a businessman; but you're not exactly a businessman, since you're in the
government," he said.

The mayor's priorities involve picking up where his father left off finishing
the Makati Science High School, fixing the roads, and lighting the streets among
other things and then creating new projects and programs.
Science and technology
An area he would like to focus on is science and technology. "We would like
to bring in technology as part of good governance," said Binay. One of his goals
is for Makati to have its own science center: "We're thinking of a
200-square-meter property. We would like to invest heavily on the sciences,
because that's the only way to go. We have to shift from being a
lawyer-doctor-engineer-architect society to a more technologically-driven
society. It's really technology that's shaping the economy."
One-stop shop
Technology as a tool for good governance is exemplified in a one-stop shop.
"If you want to open a new business, all you have to do is go to an office, give
your documents, and then you will be given a tracking number. Para wala nang
maraming kinakausap pa," explained Binay. "The process right now is very slow
and everyone wants to make it fast. It becomes a source of corruption. Now we
will make sure that all the documents get tracked, so we would know where the
delay is coming from." They are currently scouting companies and trying out
their services, so that they could have a one-stop shop in the city soon.
Education

In terms of education, they are looking into replacing bulky books with
tablets. "We would like to try it. It's really a good way to teach your children
about science and math," said Binay.
Aside from improving the educational system with the help of technology, the
local government is also finding ways to alleviate the students' and their
parents' financial burdens. "Parents don't send their children to school because
they'll have nothing to eat," shared Binay. "So for the first time, we're trying
to give each student grocery items." With the new program, they are hoping that
parents would be inspired to push their kids to study.
Free uniforms are also given to the students. "Before we just gave them
cloth, but they only turn them into curtains, because it's expensive to have
clothes sewn," he said.
Make Makati a smaller city
At the start of 2010, plans to build Bus Rapid Transits (BRTs) that will
traverse from LRT Pasay to Ayala and from JP Rizal to Kalayaan brewed. "The idea
is to make Makati smaller," explained Binay. "What we want is more public
transit, more walkways, and more covered walks, so that cars won't be needed as
much in the future." They will also put up covered walks equipped with fans and
CCTVs from Buendia and Makati Avenue to the City Hall.
Urban tourist destination

Seeing the market for tourism, Makati had recently launched its medical
tourism and wellness programs. It will also renew its partnership with Makati
Medical Center. "We're aiming for Makati to be an urban tourist destination,"
said Binay, "so we're gearing toward tourism right now, which will be the next
hot money that will come into the country. And we have partnered again with our
business sector, which is a good start, because it's not cheap to be healthy.
Our partners will be easy to locate."
Makati celebrates its 342nd founding anniversary
On June 1, Makati City will be celebrating its 342nd founding anniversary.
The month-long celebration includes a Flores de Mayo (Flowers of May) festival
and a parade. "Previously, the parade was only done in Ayala Avenue; but this
year, we will also go around historical sites," shared Binay. This will give
people a chance to learn about Makati's heritage, like two of the oldest
churches in the Philippines the Nuestra Señora de Gracia church and the Church
of Saints Peter and Paul.
Celebrating the event will be everyone from the baranggays to the business
community. "As much as we can, we get everyone involved," he said. "In fact it's
not just Makati, because we have guests coming from the provinces."

Though fairly new in his position as city mayor, Binay has always cared for
the city. "I love Makati so much. I was born and raised here. This City Hall's
actually my second home," he said. Since 1993, he was a councilor and now that
he is mayor, he feels like he could do more for Makati: "It's nice if you are
mayor, because you always plan and you get to see what's going on how things
will be developed. You're really hands-on with the execution. It's exciting."

Beyond business and luxury
Makati City has become synonymous to business and luxury. One can't think of
Makati without thinking of Ayala Triangle and Ayala Center with their high-rise
buildings, five-star hotels, fancy restaurants, and boutiques. But beyond the
bright lights and busy streets lays another side of Makati. The city is also
home to historical and cultural sites such as two of the oldest churches in the
Philippines and the country's first commercial airport.
Nuestra Señora de Gracia Church
Nuestra Señora de Gracia Church is a favorite wedding venue. It takes pride
in its Doric architecture and sturdy foundation. Built in 1629, the church
withstood an earthquake and a fire caused by a fight between Filipinos and
Americans in the 1800s. The site also known as the Guadalupe Ruins and is
located in Bernadino Street, Guadalupe Viejo, near the Loyola Memorial Chapel.

Church of Saints Peter and Paul

Built in 1620 by the Jesuit priest Father Pedro de los Montes, the Church of
Saints Peter and Paul is the first and oldest church in Makati City. Located in
Baranggay Poblacion, it is most known for its wooden altar with a carved
retablo.
Ayala Museum
The art and history museum established in 1967 was a project of the Ayala
Foundation, Inc. (AFI) and was originally located at the Insular Life Building
in Ayala Avenue. It was designed by the late National Artist for Architecture,
Leandro V. Locsin. Its current building is in Makati Avenue corner Dela Rosa
Street and is designed by the firm Leandro V. Locsin and Partners. The museum
boasts of hand-crafted dioramas that represent Philippine history.
Museo ng Makati
Built in 1918 at Baranggay Poblacion, the structure that is now Museo ng
Makati was formerly the first town hall of Makati City; and it was once occupied
by the Municipal Library as well. Aside from viewing ethnographic and
archaeological artifacts, one can come here to learn about Makati's history.

The Filipinas Heritage Library
Formerly a part of Ayala Museum, The Filipinas Heritage Library was
transferred in 1996 to Nielson Tower, the country's first commercial airport, on
Makati Avenue. The library, which is a division of AFI, is a one-stop electronic
research center in the Philippines. It has over 13,000 volumes on Philippine
history and culture and 2,000 rare titles. Its innovations include digitizing
its collections, publishing CD-ROMs, and developing web pages and electronic
databases.

BALANGA, Ba-taan, Philippines – Although 16-year-old Jessica Sanchez finished
second to Phillip Phillips in the 11th season of "American Idol," she remains
the winner in the hearts of her relatives here and millions of fans.
"It was as if my heart crumbled to pieces when her name was not announced the
winner. But still we are very proud of her, making the Bugay clan known all over
the world as an extraordinary, talented artist," said Emelita Bugay Saldaa, a
maternal relative of Sanchez in Samal town in this province.
The guitar-strumming Phillips was declared the winner of "American Idol"
yesterday after viewers cast a record 132 million votes. The 21-year-old from
Georgia, who stamped his style with individual and sometimes quirky
arrangements, beat the big voice and power ballads of Sanchez, a
Filipino-Mexican from California.
Thousands of spectators braved the rains and stood in the open plaza here to
watch the season finale of the US television show.
When Phillips was announced as the winner, the crowd let out a collective
"Ay" and stood motionless, while some said the decision was unexpected.
Ernie Bugay Esconde, a second cousin of Sanchez's grandfather Eddie Bugay,
said they are happy and very proud because Jessica is a topnotch singer, not
just because she is a relative but one "who is truly worthy of recognition."

"Whether she makes it or not, we are still happy for her credible performance
in the field of music," Esconde added.
A septuagenarian female relative said Sanchez "deserves recognition for her
spectacular feat in the world of music and her achievement should be
acknowledged by the government even in a small way."
City Mayor Jose Enrique Garcia III said the American Idol finale revealed the
inherent quality of Sanchez as a naturally gifted singer.
Garcia expressed his admiration for Sanchez in reaching the finale of the
American Idol.
"As far we are concerned, (Sanchez is) the ultimate champion and Filipino
Idol the country should be proud of," Garcia said.
He said the city government is extending an invitation for Sanchez to perform
at the historic Mt. Samat. Malacañang said Sanchez obtained the loyal and
enthusiastic support of Filipinos the world over. "Throughout her long, arduous
journey, people considered Ms. Sanchez a performer imbued with an extraordinary
gift of music and heart. This is only the beginning for Ms. Sanchez, whose
incredible talent has been recognized and appreciated the world over,"
presidential deputy spokesperson Abigail Valte said in a statement.

Vice President Jejomar Binay said Sanchez made all Filipinos proud of her
achievement.
Binay said he and the entire Filipino people consider Sanchez as the winner.

"Although Jessica Sanchez was not lucky to become the American Idol, she is
still the winner for the heart of each Filipinos," Binay said.
Lawmakers also hailed Sanchez, with accolades waiting to honor her
achievement.
Speaker Feliciano Belmonte Jr. earlier said the House of Representatives
would honor Sanchez win or lose.
"She strengthened our sense of patriotism, unity and love for our country,"
Belmonte said, adding Sanchez's achievements reminded foreigners of the many
artistic talents of Filipinos.
Bataan Rep. Herminia Roman, whose congressional district includes Samal town
from where Sanchez's mother hails, led the filing of a resolution congratulating
the American Idol runner-up.
Roman commended Sanchez "for her impeccable performance and display of
extraordinary talent during the 11th season of American Idol."
Bataan's 2nd District Rep. Albert Garcia also sponsored a House Resolution
congratulating Sanchez.
Garcia filed a resolution citing that Sanchez "has shown innate Filipino
talent which has stunned the whole world, earning adulation of millions and
making a beacon of inspiration of Filipinos everywhere, earning multiple
standing ovations from the judges throughout the competition."
Bacolod City Rep. Anthony Golez, in a separate resolution, cited the teen for
her "excellent voice and unparalleled performances."
Golez said Sanchez's "exceptional talent ... will catapult her to
international success in the music and entertainment industry."
House Majority Leader and Mandaluyong Rep. Neptali Gonzales II said Sanchez's
runner-up finish was "an excellent feat for a very young lady."
"Her unparalleled feat in AI definitely showcased the talent of Filipinos and
this alone is a huge achievement for Jessica who will always be our Filipino
idol," Davao City Rep. Karlo Alexei Nograles said.
Ang Kasangga party-list Rep. Teodorico Haresco filed a similar resolution,
saying the nation won with Sanchez.
"Some may think we have lost but we have won in our hearts. Filipinos in the
US were galvanized to support this beautiful voice. Someday soon a Filipino will
be the American Idol," Haresco said.
"Had Jessica shown a bit of 'white' from her Mexican side, the market would
have been overwhelmingly on her side," Haresco said.
'WG WG'
Phillips was crowned American Idol yesterday after winning the hearts of
millions of young women to become the fifth straight "white guy with a guitar
(WGWG)" to take the title on the top-rated TV singing contest.
Phillips, whose style has been compared to Dave Matthews and British
folk-rock band Mumford and Sons, looked stunned as his name was announced at the
end of a two-hour finale featuring performances by Rihanna, Neil Diamond and
Reba McEntire.
Sanchez, a southern Californian of Filipino and Latino heritage, on the other
hand, was declared the runner up.
Sanchez's prospects, critics said, dimmed with a less-than-impressive
performance during Tuesday's pre-vote sing-off.
The show ended with Phillips playing his country-inflicted first single
"Home," but – clearly overcome with emotion – he broke off before the end to hug
his family amid a blizzard of confetti.
"Idol" judge Jennifer Lopez sang her new single and Steven Tyler's band
Aerosmith closed the show with their 1976 classic rock tune "Walk This Way."

Fighting back tears after he won, Phillips abandoned the performance of his
new single and unstrapped his acoustic guitar to walk off stage and hug his
family in the front row of the audience.
"I feel so numb, the whole situation is unbelievable. Did I think I would
win? No, heck no," he told reporters afterward, describing himself as "not a
great singer" but someone who loves being on stage and having fun with music.

"It's so unreal, it still hasn't sunk in yet. It is such an amazing blessing
to have, and I really haven't comprehended it all," he added.
Sanchez, bidding to become the youngest ever winner of American Idol, had
come into yesterday's finale seemingly ahead as she dominated social media and
Twitter buzz in the last few days.
But Phillips' shy, goofball humor earned him a large female fan base, and he
had never appeared in the bottom three in public votes during earlier stages of
the Fox TV show.
Phillips wins a guaranteed record contract, but Sanchez is also expected to
be signed by a record label.
Two different singers American Idol mentor and record producer Jimmy Iovine
said the two singers appealed to completely different audiences.
"I think it came down Phillip having that country base and the young girl
thing going that]s hitting the button a lot of times," Iovine told reporters
backstage.
Tyler said: "He's real, we watched him pull out of his soul ... he can really
sing a melody right. He's just really evolved and he's been vulnerable, and I
think America loves that."
Phillips, who worked in his father's pawnshop before auditioning for
"Idol," also won sympathy for a recurrent kidney problem that has plagued his
health during the season.
Sanchez had a pitch perfect voice, but was sometimes faulted for lacking the
emotion needed to deliver ballads made famous by Whitney Houston, Mariah Carey
and Celine Dion.
Sanchez was saved by the judges from elimination in April after placing
bottom in public voting, and the show's judges disliked her third song in
Tuesday night's performance finale.
But Tyler said Sanchez also had a great future ahead of her.
"She sings so beautiful, so if the right person writes her the right song,
she'll be on her way," he said.
Sanchez said she had no regrets and was happy for Phillips.
"I really think Phillip deserved to win and I'm so happy for him," she told
reporters.
"Phillip has everything about him. He has his funny side and his humble side
and he's just an original artist," Sanchez said.
American Idol remains the most-watched show on US television but public
appetite for the contest and its winners is slipping after 11 years on the air
and a slew of rival, months-long talent shows.
Since the departure of acerbic British music mogul Simon Cowell from the
panel of judges, American Idol remains one of the most-watched shows of any
genre on US television.
Its impact on popular music was reaffirmed this month with past contestants
Adam Lambert and Carrie Underwood both taking turns at the top of the pop
charts.
Audiences are down about 23 percent this year, and Tuesday's
performance finale was watched by just 14.4 million people – the lowest-rated
performance finale since the show began in 2002.
American Idol launched the careers of Kelly Clarkson, Carrie Underwood,
Jennifer Hudson, Chris Daughtry and Adam Lambert – who on Wednesday scored his
first No. 1 album with his second disc "Trespassing."
With the exception of 2011 Idol winner, country singer Scotty McCreery,
recent contestants have fared less well.
A female singer has not won the title since Jordin Sparks in 2007, leading
Phillips to be dubbed the latest "white guy with a guitar" to emerge as
America's newest pop star.
For the season finale, Phillips and Sanchez shared the stage at the Nokia
Theatre in Los Angeles with a galaxy of stars from Neil Diamond to Rihanna, as
well as other top 12 season contestants with whom they will now embark on a
national tour.
Lopez and Tyler also performed along with his band Aerosmith.
Easily the most surprising moment came when Seacrest invited former Idol
contestants Ace Young and Diana DeGarmo – now an item – on stage, whereupon
Young asked DeGarmo to marry him. Cheers filled the venue when she tearfully

Balanga holds motorcade to drum up support for Jessica

BALANGA CITY, Philippines – A fiesta-like atmosphere prevails over
the historic Bataan peninsula with Jessica Sanchez's entry into the grand finale
of the popular talent search show "American Idol" Season 11.
Mayor Generosa Malibiran de la Fuente of Samal said a motorcade to be
participated in by the 14 barangays and various sectors will be held today to
drum up support leading to the much-awaited finale of the high-rating TV show.

A Mass will be held at the town plaza before the motorcade starts.
De la Fuente said they would install a wide screen at the covered basketball
court of the town plaza here to accommodate 2,000 supporters, with several
tarpaulin tents in other places leading to Barangay San Juan where reside the
Bugay family, including retired US Navy serviceman Eddie Bugay who is Sanchez's
maternal grandfather.
"We just like to show our support for Miss Sanchez," De la Fuente said.
The Bataan Mayors League has approved a resolution commending Sanchez for her
noteworthy performance and artistic interpretations of songs that earned her
worldwide notice during the contest, De la Fuente said.
"Miss Sanchez's performance will forever (remain) in the hearts of the
Filipino people as the first Fil-Am and Asian to reach the highly competitive,
world acclaimed American Idol," she added.
Balanga City Mayor Jose Enrique Garcia III is preparing the town plaza to
accommodate some 3,000 spectators for the viewing of the two-day grand finale.

Garcia said Balanga residents are extending their support to Sanchez.
"We want to invite Miss Sanchez to hold her first concert in the Philippines
in her home province, to make it more special we can do the project atop the
historic Mt. Samat National Shrine in Pilar town," he said.
Gov. Enrique Garcia Jr. said whatever happens tomorrow, Sanchez is already
the winner in the hearts of all Filipinos.
"We are doubly proud that she has roots in the province of Bataan and that
last week, she wore an elegant creation of renowned designer Oliver Tolentino
who is also a native of Orani," Garcia said.
Garcia added the triumph of Sanchez in American Idol should be an inspiration
to all aspiring youth with talent and should make them proud of being
Filipino.

Solon files House resolution congratulating Jessica Sanchez

BALANGA City, Bataan - A congressman on Thursday filed a resolution
congratulating Jessica Sanchez for emerging runner-up in the just concluded 2012
"American Idol" Season 11.

House Resolution No. 2444 to commend the 16-year-old singer with Filipino blood.


"Malaking karangalan si Jessica hindi lamang sa ating lalawigan kundi maging
sa buong bansa," he said.

Garcia said he felt sad just like everybody else when Sanchez did not win the
AI crown. "Lahat nalungkot pero at the same time we should be proud of her
because she faced a stiff competition and yet she attained quite a feat," the
congressman said.

Sanchez emerged as second to champion Phillip Phillips.

Garcia as well as many other Bataeños consider Sanchez as a kababayan. Her
mother, the former Editha Bugay, has roots in barangay San Juan in Samal,
Bataan.

The Bataan lawmaker described Sanchez as showing innate Filipino talent which
he said has stunned the world, earning the adulation of millions and becoming a
beacon of inspiration to Filipinos everywhere.

"Her talent, humility, and passion has united Filipinos the world over and
has given us another Filipino champion to emulate," Garcia said.

He said Mayor Cox of the Chula Vista in San Diego, California has proclaimed
May 12, 2012 as Jessica Sanchez Day. "Should she decide to come home, we should
accord her the same honor," the congressman said.

Meanwhile, another solon has filed a resolution intending to honor Sanchez.


Bataan Rep. Herminia Roman filed House Resolution (HR) No. 2425 to recognize
the teener's achievements.

House Speaker Feliciano Belmonte Jr. said the House will give Sanchez the

City Government of Balanga gives tribute to Jessica Sanchez


Officials and employees of the city government of Balanga in Bataan sent
congratulatory messages and gave tribute to American Idol finalist Jessica
Sanchez during Monday's flag-raising ceremony at the Plaza Mayor de Balanga.

"Sa tulong ng ating pagdarasal, magtatagumpay si Jessica na isang Pilipino,

Garcia said in jest that perhaps Jessica has become a good singer because of
boneless bangus that other contestants do not have. Bataan, Orani in particular,
is known for boneless bangus aside from tasty crabs and prawns.
Jessica's mother Editha has roots in Orani and Samal towns in Bataan. She is
one of three daughters, all in the United States, of retired U.S. Navy man Eddie
and Virgie Bugay of Orani. Editha is married to a Mexican.
Garcia said they will send Jessica through Youtube two congratulatory
messages. "Congratulations Ms Jessica Sanchez – Galing ng Pilipino, Galing ng
Bataan – We will always love you!," reads the first message.
"Congratulations Ms. Jessica Sanchez – Talentong Bataeno, Idolo ng buong
mundo – Ipinagmamalaki ka namin!," says another message.
A short video clip on the latest performance of Jessica in American idol was
shown at the big screen on the stage in the plaza. City hall officials and
employees gasped in awe and cheered as Jessica sang "I will always love you."

All eyes were glued on the screen. Plaza Mayor erupted in the din of applause
as the three AI judges gave encouraging and superb remarks on Jessica.
After the showing, the employees and officials sent the two messages in

Would the presence of Manny Pacquiao have helped sway the vote for Jessica
Sanchez had he shown up on time at the Nokia Theater where the American Idol
grand finals was held Wednesday last week?
"I really doubt it," said Dr. Vicki Belo who was there. "Most of Manny's
fans/followers are men and it was mostly women who did most of the voting. But
for sure, Manny could have given Jessica moral support."
Manny was in the thick of pre-fight (with Timothy Bradley on June 10, Manila
Time, in Las Vegas) workout at the Wild Card gym in L.A. and he did go to Nokia
only after the show.
"I fetched him at Wild Card but he couldn't cut short his training, so I went
ahead to Nokia," said Vicki who was seated at the seventh row. "But had Manny
been with me, we would have been put on the first row."
Vicki estimated that Phillip Phillips, the winner, had more supporters inside
the venue than Jessica, second-placer, did – approximately 60 percent for
Phillip and 40 percent for Jessica.
"Two of Jessica's songs, I Have Nothing and The Prayer, were by David
Foster," noted Vicki. "Her third song, Change Nothing, was parang not
bagay sa voice niya although she admittedly did them beautifully. Phillip scored
high especially with his third song, Home. His style was medyo hindi
tumatawa. He started the song medyo slow but when he reached the chorus, he
began to smile and that won the crowd's heart na mostly babae. Our group was
maka-Jessica but when we heard Phillip sing Home, we got so carried away that we
stood up with the rest of the audience and we applauded."
Conceding that Jessica's voice is perfect for the songs by David Foster, who
with his wife are Vicki's best friends, Vicki said that she hoped that Foster
would help Jessica like he did Charice. ("Foster was never Charice's manager,"
clarified Grace Mendoza, Charice's Philippine manager, in a separate interview.
"Oprah, Charice's godmother, only asked Foster to help Charice.") "I'm sure that
David would love to meet Jessica, if ever."
Before coming home, Vicki met up with Willie Revillame who arrived during the
weekend in L.A. for the TV5 launch on May 26 with his show Wil Time Bigtime
(with another starting this weekend, June 2, in San Francisco).
"But as far as I'm concerned," added Vicki, "Jessica is a winner in her own
right," with a possible recording contract with Sony Music, as reported by
Thalia herself, wife of Sony boss Tony Mottola, in her Twitter.
Incidentally, could it be true that Vicki is dissociating herself from the
group that put up a Belo Medical Clinic in Glendale, California, last year
because she couldn't practice her hands-on style of management (as she does with
her local outlets) since she couldn't be in California as often as she wanted
to?
Henceforth, Vicki's name will be removed from the clinic's name.

the trade sanction that China slapped on the Philippine exports has yet been
fixed even as the clearance that the Philippine agriculture officials got for
the banana exports from the Chinese authorities isnt an assurance of a
continuing trade partnership between the two countries.
No less than the Pilipino Banana Growers and Exporters Association (PBGEA)
shrugged off statements issued by deputy presidential spokesman Abigail Valte
boasting of what has been referred to as another government accomplishment in
securing the clearance for the entry of some 190 containers of Philippine
banana exports into Chinese territory.
While PBGEA executive director Stephen Antig confirmed that their banana
exports, which were barred from entering China three weeks ago, have indeed been
allowed to go past the Chinese ports, there is still no assurance that their
fruit exports most of which have already found rotten, would be sold.
He added some 240 container vans containing their banana exports are already
on their way back to the Philippines.
There havent been any takers for our banana exports. The Chinese are not
buying bananas from the Philippines, although China has allowed its entry, Antig
said in an interview over a Davao-based radio station.
Malacaang keeps on saying China is open, but nobody is buying. The Chinese
buyers are still not buying Philippine bananas. It is different when they say it
is open, but the buyers are not buying.
The Philippine-based banana exporters, who claim to have incurred a combined
loss amounting to at least P2 billion, are expecting their shipments return to
the Philippines anytime soon because they have got any order anyway.
They have also stopped sending bananas to China while some 240 container vans
containing the rotten fruits are due to return this week.
Amid the losses incurred by the Philippine banana exporters, Malacaang is set
to announce Monday an assistance package for them.
The government, however, did not say whether the assistance program would
include the 35,000 small banana growers from whom the exporters get their
commodities on a consignment basis.
Valte said China has allowed the entry of at least 190 container vans of
Philippine bananas.
The team of the Department of Agriculture is still in China, she said.
The agreements that we shared with you the other day still stand, that before
the exports leave the country there will be double checking. And once the
(bananas) get there, there will be a joint inspection to be conducted by both
sides.
On top of the assistance, the government is exploring other markets.
Malacaang insiders said government emissaries have been talking to Singapore
authorities for a possible trade partnership that would involve fruit exports
from Mindanao.
Also, training interventions are being set up to turn into agricultural feeds
ripe bananas that have failed to make it to the Chinas market due to its sudden
implementation of stricter quarantine measures.
Secretary Joel Villanueva, director-general of the Technical Education and
Skills Development Authority (Tesda), in a statement, said he has instructed
their offices in Southern Mindanao regions (Regions XI and XII) to gather
relevant data needed to develop an alternative market for the countrys banana
growers amid the problem in China.
Tesda is taking a proactive position and is now simultaneously gathering the
relevant data needed to prepare for introducing an alternative market for the
countrys huge banana produce, he added.
Tapping the manufacture of agricultural feeds, he said, is one option that
banana producers can venture into to guarantee that the fruit could be turned
into profit.
Since March this year, China has tightened requirements for the entry of
fruits after it claimed it had found pests in bananas from the Philippines.
Banana growers said they have lost at least P1.44 billion since the restrictions
were imposed.
According to the National Statistics Office, the Philippines exported over
two billion kilograms of bananas valued at $472.4 million. Of the total, 403.4
million kilograms, valued at $85.283 million, went to China.
China is a major market for banana exports. It also purchases pineapples and
papaya from the Philippines.
Banana feeds are processed through natural drying. Using multi-purpose
dryers, Tesda said workers and planters can efficiently and quickly convert the
bananas into feeds, an alternative by-product of the fruit.
Villanueva said workers would undergo training on the complete process of
making feeds from bananas, using the available technology for better
productivity.
We have to find alternatives like diversifying our markets and making new
produce to make the industry less vulnerable to shocks, he added.
Rotting bananas need not go to waste. We just have to tap the skills of our
workers and the right technology to create an opportunity out of this event,
Villanueva added.
Earlier, banana producers and exporters in Mindanao said that they are
considering tapping the governments feeding program, as well as the domestic
market, for the bananas that were not sold to China. Jason

While Beijing has again allowed qualified Philippine bananas to enter the
Chinese market, few people in the country are buying the imported fruit, reports
the Philippine Star.
Stephen Antig, executive director of the Philippine Banana Plantation and
Export Industry Association, was reported as saying that if few orders are
placed, whole shipments of bananas will be returned to the Philippines.
Since March, inspection and quarantine authorities in various Chinese ports
have repeatedly quarantined pests found on fruit imported from the Philippines.
China later stepped up examinations of fruit imports. The Philippine banana
industry is worried about how the stricter examinations will affect business.

The lack of interest in Philippine bananas is no doubt the result of a
standoff between Beijing and Manila over Scarborough Shoal, a group of tiny
islands that lie roughly 220 kilometers from the Philippines. The standoff began
on April 10 when two Chinese fishery administration ships were deployed to
prevent the Philippine navy from arresting and detaining Chinese fishermen who
had been apprehended in an area, which is claimed by the two sides.
Antig also said that China intends to return about 100 boxes of Philippine
bananas. He added that, to his knowledge, 240 containers of bananas are
currently being returned to the Philippines. As Chinese importers do not want to
buy them, nobody has asked about the bananas, which were been sent to various
ports in China.
Bananas are the Philippines' fifth-largest agricultural export; of these,
half are exported to China. In 2011, the Philippines accounted for 85% of
China's total imports of bananas.
They are concerned about the development of the conflict of Scarborough Shoal
might also impact on banana exports.

President Benigno Aquino III, responding to the stringent phytosanitary
concerns of China, has ordered government agencies to ensure that packaging
warehouses and facilities of small-scale banana exporters are up to world-class
standards.

"The President has already given the instructions to Department of
Agriculture to assist the small players in making sure that they are compliant
with international standards as to our exports," said Presidential Deputy
Spokesperson Abigail Valte at a press briefing Monday.

Valte said DA and Bureau of Plant Industry personnel will go to the
warehouses to check and inspect on the processes of small-scale exporters and
they will determine how they can be assisted further.

"The assistance makes sure that they meet the standards that are required. So
it will start from 'yung packaging warehouses po nila to make sure that they are
compliant with the standards," she said.

However, Valte explained that the guidance and assistance to be given by the
DA and BPI is different from the assistance package being crafted by the
economic team.

Last week, Presidential Spokesperson Edwin Lacierda said the economic team is
expected to submit to the President an assistance package for banana growers.


Valte noted that there is no problem with major exporters as their facilities
have already passed international standards.

"Wala po silang problema dahil world class naman po 'yung mga standards nila.
As we have said, nag-e-export po tayo sa Japan whose standards are very
stringent and we meet those standards," she said.

Chinese agriculture officials had earlier intercepted and blocked 40-foot
containers of bananas from the Philippines, claiming the fruits were infested by
Aonidiella comperei, a type of worm more commonly found in coconuts.

The banana blockage is seen as a facet of the escalating tensions between
China and the Philippines over the Panatag Shoal

Bananas are the Philippines' no. 2 agriculture commodity export after
coconuts, earning about $720 million a year. According to the DA, the banana

Sonia Brady named envoy to China By Norman

MANILA, Philippines—President Benigno Aquino III named a veteran
diplomat as the country's ambassador to China amid a tense standoff over
disputed territory in the West Philippine Sea (South China Sea), a presidential
spokesperson said Saturday.
Sonia C. Brady (photo), 70, who served as ambassador to Beijing from
2006 to 2010, was named to her old post amid a growing clamor for a skilled
diplomat to handle the frayed ties with China caused by the territorial dispute.

The President wanted "someone who is already familiar with the politics and
the culture of that country. That person can hit the ground running," said
spokesperson Abigail Valte.
"Given the complexities of our relationship with China right now, it has to
really be somebody who is the best we can produce," Mr. Aquino said in an
earlier interview when asked about his search for a new ambassador to China.

Brady, however cannot assume the post until Congress approves her
appointment.
President Aquino's last nominee to the post, family friend Domingo Lee, went
through a rough time in the bicameral Commission on Appointments (CA) despite
the urgent need for a diplomatic representative in Beijing, given the
territorial issues in the region. Congress refused to approve the posting,
saying that Lee was inexperienced.
Lee opted out after the CA again deferred his appointment before Congress
went on recess. He has since been appointed special envoy to China for tourism.

Another special envoy to China, Cesar Zalamea, is in charge of trade affairs.

"Brady has been to China. We expect her to use her experience and contacts to
provide added insight and understanding of Chinese actions and policies," said
Secretary Ricky Carandang, head of the Presidential Communications Development
and Strategic Planning Office.
The career appointment came in the wake of the country's protests over
Chinese incursions into undisputed Philippine territories in the West Philippine
Sea. There is also that standoff between the Philippines and China over the
Panatag (Scarborough) Shoal off Zambales.
Relations between the two countries worsened after Chinese ships blocked
Philippine vessels from arresting Chinese fishermen in April.
Both countries have deployed vessels near the disputed Panatag Shoal for more
than a month to press their conflicting claims to the area.
China claims the shoal along with most of the West Philippine Sea, even up to
the coasts of its Asian neighbors, while the Philippines claims the shoal as
being well within its 200-nautical mile exclusive economic zone.
As ambassador to Beijing, Brady has concurrent jurisdiction over North Korea
and Mongolia.
Brady has been an adviser on foreign affairs since Aug. 19, 2011. She was
foreign affairs undersecretary for policy from 2003 to 2006.
No stranger to China, she also served as third secretary and vice consul and
was later second secretary and consul from 1976 to 1978.
She was also a special assistant before becoming an assistant secretary in
the Department of Foreign Affair's Office of Policy and Coordination from 1999
to 2002.
Brady was a director in the Office of the Asia Pacific from 1988 to 1992 and
had been assigned to the Office of Political Affairs from 1968 to 1976.
The career diplomat from Quezon has a degree in journalism from the
University of Santo Tomas, from which she graduated magna cum laude in 1962. She
earned her foreign-service degree at the University of the Philippines a year
later.
She obtained a master's degree in international relations from the University

sides in the impeachment trial of Chief Justice Renato Corona presented their
closing arguments Monday, but Senate President and Presiding Judge Juan Ponce
Enrile, who is seen to hold the swing vote, ended the hearing with questions to
the defense.
After both sides had completed their presentation, Enrile asked the defense
what damage would be done if a public official disclosed his dollar accounts
regardless of the confidentiality guaranteed by the Foreign Currency Deposits
Act.
Enrile reminded the court that while the law barred banks from disclosing
details of bank accounts, no such prohibition existed for the depositor, who was
free to waive the secrecy of his deposits.
"What is prohibited is for third parties to reveal it and that's why they're
penalized. But the depositor is not," Enrile said.
He then asked the defense if it felt Corona had been guilty of culpable
violation of the Constitution when he disregarded its provision ordering
officials to report their assets, liabilities and net worth— including their
dollar accounts.
The question was left unanswered—and will likely be the key when the senators
vote today to either acquit or convict the chief justice after a months-long
campaign by the Aquino administration to oust him from office.
The Palace, led by President Benigno Aquino III, had mounted a nationwide
effort and used the entire government machinery to oust Corona.
House Speaker Feliciano Belmonte Jr., who was not a member of the prosecution
panel, delivered the closing statement that did not delve on the evidence
against Corona, but on his "character and moral fitness" to remain in office.

Since Day 1 of the trial, the senator-judges, saddled with a flawed
impeachment complaint and the prosecution's inability to deliver hard evidence
proving any high crime, seemed at a loss on whether Corona was guilty of
culpable violation of the Constitution and betrayal of public trust as charged
by the House prosecutors.
Senator-judge Miriam Defensor Santiago, to the end, raised the question as to
the extent the court could penalize the chief justice and raised the possibility
of censure, reprimand or suspension.
But Enrile was also clear that the vote must only be to acquit or convict
Corona.
While many of the judges seemed to have already made up their minds to
convict, the defense hammered on the prosecution's failure to produce any
evidence against the chief justice, still hoping to win acquittal.
Enrile's vote is viewed as crucial as he is perceived to have his own bloc in
the Senate, including Senate President Pro Tempore Jinggoy Estrada, Senate
Majority Leader Vicente Sotto III and Senator Gregorio Honasan.
The four votes could spell acquittal or conviction for Corona.
The prosecution needs 16 votes to convict Corona, who, as of this writing,
sources said only had sure four solid votes for acquittal: those of Santiago,
Joker Arroyo, Ferdinand Marcos Jr. and Manuel Villar.
Bringing in Enrile's bloc of four votes would grant Corona an acquittal, as
he only needs eight votes to win the trial.
But Villar, sources said, might vote for conviction since his wife Cynthia,
who is gunning for the Senate, was being wooed by the Palace to run under the
administration slate.
The prosecution, from the start, has insisted that the impeachment trial is a
"political exercise" with no less than the President leading the anti-Corona
campaign.
The prosecution also formed the 188 Movement, consisting of the 188 lawmakers
that signed the impeachment complaint that brought their campaign against the
chief justice to their home provinces.
But the prosecution immediately dropped the assertion that the impeachment
was a political exercise when they learned that Corona was being supported by
the influential Iglesia ni Cristo.
Malacañang was even quick to debunk rumors that the Feb. 28 rally of the
Iglesia was meant to support Corona, who denounced the Palace for attacking the
independence of the Supreme Court and threatening the system of checks and
balances that are key to a democracy.
On the eve of Corona's appearance before the Senate impeachment court, the
President himself went to see the leadership of the Iglesia to explain why the
government was pursuing the chief justice's ouster.
The Iglesia brings with it a solid vote of 8 million members nationwide that
the reelectionist senators—Francis Escudero, Loren Legarda, Antonio Trillanes
IV, Alan Peter Cayetano, Honasan and Aquilino Pimentel III—will also likely take
into account.
Escudero said he was not impressed by the closing arguments Monday, but the
folksy address of prosecutor and Ilocos Norte Rep. Rodolfo Farinas, who
dismissed Corona's explanations for not declaring his bank deposits as "palusot"
or excuses, would resonate.
The defense, on the other hand, stressed that the prosecution had failed to
bring in evidence to pin down Corona.
Defense counsels retired Justice Serafin Cuevas, Eduardo delos Reyes and
Dennis Manalo pointed out that the prosecution had failed to answer most
questions because they did not bother to cross-examine Corona when he went to
court to testify.
They said the prosecution was only successful in making innuendos and casting
doubt on Corona's dollar and peso accounts.
The prosecution asked the Senate impeachment court to convict Corona by
insisting that he failed to disclose "truthfully and accurately" his assets in
his statement of assets, liability and net worth the $2.4 million in dollar
accounts and P80.7 million in peso accounts that Corona said were not his but
co-mingled accounts from the members of his family.
Shortly before the hearing ended Monday, Enrile posed his questions to the
defense.
"What injury or prejudice may arise if a depositor who is public officer or
employee of a foreign currency deposit would include that deposit or the amount
represented by that deposit in his SALN?"
Cuevas said he was not sure what damage could be done, but mentioned the
threat of kidnapping as one possibility.
At this point, Enrile said the Foreign Currency Deposits Act merely barred
banks, not depositors, from revealing details of their accounts.
He then asked the defense if the constitutional provision on providing a
statement of assets, liabilities and net worth was a mandatory requirement that

"My next question is, if it is a sovereign command… will disobedience
constitute a culpable violation of the Constitution?" Enrile continued, using
the Latin root word "culpa" or "failure" to make his point.
He dismissed Cuevas' distinction about whether or not the failure was
intentional or out of negligence, saying it did not matter.
Before the hearing started, Enrile also took Cuevas to task for telling an
interview that they could file an appeal to the Supreme Court if Corona was
convicted, reminding him that the Senate had the sole power to try and decide
impeachment cases under the Constitution.
But Cuevas denied there was any plan to make an appeal.
"We're still waiting for the trial to be finished," he said.
Despite Enrile's questions, defense spokeswoman Karen Jimeno said she felt
the defense presented a very strong legal argument for acquittal.
Prosecutor Reynaldo Umali, on the other hand, said they were optimistic
