MANILA, FEBRUARY 12,
2012 (TRIBUNE) FRONTLINE Ninez Cacho-Olivares - Let it not
be forgot ever, if a constitutional crisis comes to a head, and the country will
no longer be a government of laws, but of men, that the culprit for this rule of
force is none other than Noynoy Aquino, a dictator finally emerging from his
closet, now that he is drunk with power and control over the House of
Representatives.
Not satisfied with lording it over his rubber stamp House, despite its
members having delivered the head of the Supreme Court (SC) to be fed to the
lions, he now wants not only full control of the high court but also of the
Senate.
With the high court having issued an indefinite temporary restraining order
sought by the Philippine Savings Bank against the disclosure of Chief Justice
Renato Corona's dollar account, he, along with his aides, has called on the
senator-judges not to obey the SC's TRO, which is no different from telling the
nation that the rule of law should no longer be obeyed; only his rule — or
whatever he and a subservient SC say is the rule, and his law that must be
followed.
What he does not realize is that, by calling on the senators to ignore the
TRO, just as his Justice secretary, Leila de Lima, ignored the SC's TRO on her
clearly illegal and unconstitutional hold departure order against the Arroyos,
and just as his Finance Chief Cesar Purisima and BIR Chief Kim Henares ignored
the TRO issued by the high court on a tax collectible, he has placed the Senate
as an institution, in serious question by way of its independence and integrity
— should the senators decide to ignore the SC's TRO.
If the Senate does ignore the TRO, it not only will be throwing out of the
window the tripartite republic system of government, but will also be a full
partner of the madman in Malacañang in destroying the rule of law and the system
of checks and balances, giving its imprimatur to the rule of the mob in
Malacañang.
Will these senators — at least the majority — go along with Noynoy and obey
his wish to destroy the rule of law in this country?
The nation knows that his lapdogs in the Senate will. They have already made
their position against the SC TRO public, claiming, as stupidly as their
political master in the Palace claims, that they, as an impeachment court, are
superior to the high court and that the SC cannot question their rulings, as
they are supreme.
Yet the Constitution is clear: The SC has the sole power and authority to
intervene in questions of law and interpret the law and the Constitution, as it
is its sole interpreter, and it has been mandated by the people, through the
ratified Constitution, to rule on whether there has been grave abuse of
discretion committed by any agency in government.
Some senators and congressmen always claim that theirs is the voice of the
people and that which they do by way of impeaching the SC head is what the
people mandate them to do.
But that is a limited view of being the voice of the people, because it is
also the people who had mandated the constitutional provisos existing today when
the Filipino people ratified the 1987 Constitution.
And what the Filipino people mandated is for the existence of three separate
branches of government, co-equal and with separate and distinct functions under
a tripartite system of government.
The people too, have mandated, as the Constitution states, that the Supreme
Court be given the power of judicial review, which means that the people have
authorized the high court to be the final reviewer of constitutional questions
and has the final say on what the law is.
What the high court cannot do, is to overturn a verdict of conviction of an
impeached official who will have been found guilty by the Senate court.
All other violations committed by the impeachment court can be ruled by the
high court, and not by Noynoy and his mob.
What the people did not mandate if for a president of the republic to destroy
that which they had mandated, as Noynoy must know, all government power emanates
from the people — not Noynoy.
Throw away the rule of law, and we will have turned into a chaotic nation,
doing what we want and ignoring whatever the law says.
If such happens, put all the blame on Noynoy and those who heed his
unconstitutional marching orders.
