ABS-CBN filed a P127 million copyright infringement case against Willie Revillame, his production outfit (WilProductions, Inc.), and TV5, before the Makati Regional Trial Court (RTC) on Wednesday.
As published on its official news website, ABS-CBN network said that Willie Revillame's new show at TV5, Willing Willie is 'undeniably a copycat of Wowowee'.
Apparently, the 33-page complaint filed by ABS-CBN against Willie Revillame and TV5, stated that as the producer of the defunct show Wowowee, it is entitled to protection against illegal copy, as cited in section 172.2(l) of the Intellectual Property Code.
Although Willing Willie has different title and segment titles, ABS-CBN said that there were acts of plagiarism made by the show, in which some of them are explained below, as taken from their post.
ABS-CBN's TRO Petition Against Willie Revillame's "Willing Willie" Show Junked By Court of Appeals
Court of Appeals (CA) rejected the petition of ABS-CBN to stop immediately the airing of Willing Willie, the new variety game show of Willie Revillame on TV5.
As reported last Monday on a local newspaper, Court of Appeals did not grant the petition of ABS-CBN to impose a temporary restraining order (TRO) to take effect immediately on Willing Willie game show.
Associate Justice Priscilla Baltazar-Padilla wrote a three-page resolution giving Willie's camp to answer ABS-CBN's petition. The Kapamilya network was also given five days to answer Willie's arguments.
It was reported that ABS-CBN first filed for a TRO against Willie last October 4 in Quezon City Regional Trial Court. However, Judge Luisito Cortez of Quezon City Regional Trial Court branch 84 did not issue any decision on October 8 hearing. According to Judge Cortez, ABS-CBN was not able to prove that there is an "urgent need" for the court to issue a TRO before the premiere show of Willing Willie.
In this connection, ABS-CBN again filed a petition to QCRTC last October 15 to rush Judge Cortez's decision to issue immediately a TRO before the premiere launching of Willie Revillame's show last October 23. However, still not lucky to get the decision of the judge.
