NOY: SUPREME COURT DECISIONS DIFFICULT TO UNDERSTAND

MANILA, OCTOBER 17, 2010 (STAR) By Aurea Calica - President Aquino said that the Supreme Court's (SC) recent decisions are counterproductive, but he expressed confidence that the executive branch would win the cases brought before it.

"Medyo mahirap intindihin (Quite difficult to understand). There are decisions that I'm not comfortable with," the chief executive said in a recent meeting with The STAR editors when asked whether the SC was a hindrance to his administration or if he just needed a better legal team to craft his orders.

He cited the SC's decision to issue a status quo ante order on the impeachment case against Ombudsman Merceditas Gutierrez pending before the House of Representatives.

Gutierrez said no new impeachment complaints should be filed against her within a period of one year based on the Constitution.

Mr. Aquino said that instead of a temporary restraining order (TRO), the SC issued a status quo ante order, "so all the more nothing will happen."

The President said he was expecting the SC not to take cognizance of the matter, impeachment being a political case but it not only took cognizance, it even "turned back the clock."

The President also slammed the SC over its status quo ante order on a midnight appointee, who questioned Executive Order No. 2 revoking all midnight appointments made by former President Gloria Macapagal-Arroyo.

He said the order could set a bad precedent and derail his reform agenda since even questionable deals during the previous administration, which he had stopped, could be appealed along with the appointments made two months before Arroyo's term ended.

As regards Executive Order No. 1, or the creation of the Truth Commission that was also questioned before the SC, Mr. Aquino expressed belief that the panel would be given the go signal to proceed.

"The goal was to put closure to all the past anomalies and controversies and if there are questions to particular methodology then we will amend accordingly," he said, adding that they would find the proper methodology to be used but the goal should be achieved.
